Summary of Copying Licences
The University holds a number of licences that allow staff and students to make copies of printed materials and radio/TV broadcasts that would otherwise be protected by law. Such copying must adhere to the conditions summarised below and be undertaken for the educational purposes of the University. The licences do not permit copying for teaching or research that are undertaken commercially, e.g. under the auspices of UMIP Ltd. or as private consultancy.

PHOTOCOPYING BOOKS AND PERIODICALS
The University holds a licence from the Copyright Licensing Agency (the CLA) which acts on behalf of authors and publishers. This licence covers the majority of conventionally published books and journals, although there are some important exceptions (see below). Within the limits specified below, it allows multiple copies to be made for educational purposes, e.g. the provision of photocopies to students.
Within each 'course of study' (i.e. each separately assessed programme unit) all copying, including material included in course packs for students, must not exceed either singly or in aggregate the greater of 5% of any published edition, or:
- in the case of a book, one complete chapter;
- in the case of an article in an issue of a serial publication or in a set of conference proceedings, one whole article;
- in the case of an anthology of short stories or poems, one short story or poem not exceeding ten pages in length;
- in the case of a published report of judicial proceedings, the entire report of a single case.
Note that here is a limited number of published works that are not included in the CLA licence. These are:
- printed music (including the words);
- maps, charts or books of tables;
- texts of public examination papers, whether published individually or in collections;
- workbooks, work cards and assignment sheets;
- privately owned documents issued for tuition purposes and limited to clientele who pay fees;
- newspapers (for which the University has a separate licence from the Newspaper Licensing Agency);
- industrial house journals and other free publications primarily for employees of commercial business, industrial undertakings or public services;
- any work on which the copyright owner has expressly and prominently stipulated that it may not be copied under this Licence;
- any work included in the List of Excluded Works produced by the CLA;
- works published outside the Mandating Territories (which are the UK, Australia, Canada (including Quebec), Denmark, Finland, France, Greece, Germany, Iceland, Ireland, The Netherlands, New Zealand, Norway, South Africa, Spain, Sweden and Switzerland)
NOTE: In particular, the USA is outside the Mandating Territories, and works published in the USA are therefore not generally covered by the terms of the CLA licence. The only USA publishers whose material can be copied under the licence are those included in the CLA's list of Participating US Publishers.
Please note also that:
1) Copies may be made of copies, provided that the University owns the original published edition, or has obtained it on a copyright cleared basis, or has permission to make the copies. This legitimises the placing of copies of extracts in the Library's Short Loan Collection for further copying by students.
2) Photocopies of extracts from published works may be sold to students on a cost recovery basis only (i.e. not for profit).
3) One copy may be supplied to commercial or other organisations that fund research in the University, in connection with the research project(s) for which the funding is provided. Please note that this the only permission to copy in a commercial context: in general, copying is licensed for non-commercial purposes only.

PHOTOCOPYING NEWSPAPERS
The University holds a licence from the Newspaper Licensing Agency (NLA) that broadly permits the photocopying for educational purposes of articles published in national daily and Sunday newspapers and the Manchester Evening News. The following conditions apply:
- up to 250 copies of any one article/report may be made;
- the copies made must contain the header 'with permission, copied from ... dated ... ;
- separate photographs and advertisements may not be copied (the newspaper will generally not own the copyright of these);
- articles/reports may not be scanned and distributed electronically. Photocopying only is permitted.

RECORDING AND PLAYBACK OF TV AND RADIO BROADCASTS
The University holds a licence from the Educational Recording Agency (ERA) that permits recordings to be made of most broadcast material and the subsequent playback of such material to students for educational purposes.
Please note that this licence does not cover the recording of Open University programmes, which are the subject of a separate licensing arrangement. (This is administered by the Media Centre: if you wish to obtain copies of OU materials, please email
media-centre@manchester.ac.uk.)
Note also that the ERA licence does not permit the copying of commercially available recordings (videos, CDs, DVDs etc.).
The main features of the ERA Licence are:
- recordings can be made of any broadcast material (terrestrial, satellite, cable) provided that the subsequent showing of the recording is required for and is in connection with the purpose of a student's course of study;
- recordings may be retained for repeated use;
- recordings must be labelled with the statement 'This recording is to be used only under the terms of the ERA Licence';
- recordings may be edited to create compilations, but not adapted in any way;
- recordings may be made by members of staff at home as well as on University premises (The Media Centre will make recordings on request);
- recordings may be lent to students for legitimate educational purposes (the student must sign a declaration to this effect).

SCANNING DOCUMENTS ELECTRONICALLY
The University holds a licence from the CLA which allows us to make digital copies of material from printed books and journals. This licence is being trialled nationally at present and is subject to monitoring. In order to ensure that our use of it is properly recorded, all digital copying and scanning must be carried out by the John Rylands University Library. There are restrictions on the printed works that can be copied in this way, and on the subsequent use and distribution of digital copies; however digital copies may be included in online teaching materials that can only be accessed by students and staff (e.g. in a WebCT course).
